Terms of Service

1. Services Provided

Oussama Abiba (operated by Oussama Abiba, Marrakech, Morocco) provides professional photography, videography, and content creation services. Services are confirmed only upon receipt of a written confirmation and deposit as specified in the applicable quote.

2. Booking and Payment

• A non-refundable deposit of 30% of the quoted price is required to confirm your booking date.
• The remaining balance is due on the day of the shoot or upon delivery of final files, as specified in your quote.
• Prices are quoted in Moroccan Dirhams (MAD) or Euros (EUR) as agreed and are inclusive of all applicable taxes unless otherwise stated.
• Payment methods accepted: bank transfer, cash, or other methods agreed in writing prior to the shoot.

3. Cancellation and Rescheduling

• Rescheduling: Free of charge if requested at least 72 hours before the session, subject to availability.
• Client cancellation: Cancellations made more than 7 days before the session receive a refund of the balance minus the deposit. Cancellations within 48 hours of the session forfeit the full deposit and any other amounts paid.
• Oussama Abiba cancellation: If we need to cancel due to unforeseen circumstances (illness, equipment failure, extreme weather), we will reschedule at no charge or refund all amounts paid in full.

4. Intellectual Property and Image Rights

• Oussama Abiba retains full copyright ownership of all images, videos, and creative works produced.
• Upon receipt of full payment, you are granted a non-exclusive, perpetual licence to use the delivered files for the agreed purposes (website, social media, print, advertising).
• You may not resell, sub-licence, or transfer these files to third parties without written consent.
• Oussama Abiba reserves the right to display and promote selected images in its portfolio, website, and social media unless a confidentiality agreement is in place.
• Exclusive rights (preventing portfolio display) may be negotiated for an additional fee.

5. Client Responsibilities

• Ensure the shoot location is accessible, properly prepared, and meets the conditions agreed in the project brief.
• Obtain any necessary permits or permissions for the shoot location.
• Ensure that all individuals appearing in the shoot have consented to being photographed/filmed.
• Provide accurate project details at the time of booking. Significant changes to scope after confirmation may incur additional charges.

6. Deliverables and Revisions

• Deliverables are as specified in the confirmed quote (file count, format, resolution).
• One round of minor revisions is included. Additional revisions are billed at our standard hourly rate.
• Delivery timelines are estimates and may vary. We will notify you of any delays.
• Raw/unedited files are not included unless explicitly agreed and priced.

7. Limitation of Liability

To the maximum extent permitted by law, Oussama Abiba shall not be liable for any indirect, incidental, or consequential loss or damage arising from the use of our services. Our total liability in connection with any single project shall not exceed the fees paid for that project.

We carry professional equipment insurance. In the unlikely event of equipment failure or data loss preventing delivery, our liability is limited to a full refund of amounts paid.

8. Use of the Platform

• You must be at least 18 years old to create an account and submit bookings.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree not to use the platform for any unlawful purpose or in a way that infringes the rights of others.
• We reserve the right to suspend or terminate accounts that violate these terms.

9. Governing Law

These Terms of Service are governed by the laws of the Kingdom of Morocco. Any disputes shall be subject to the exclusive jurisdiction of the courts of Marrakech, Morocco.

10. Changes to These Terms

We reserve the right to update these terms at any time. Changes are effective upon posting to this page. Continued use of the platform constitutes acceptance of the updated terms.
